10. Governing Law and Dispute Resolution

In the event that a dispute arises relating to these Terms or your use of the Site, the parties agree to first engage in good-faith formal mediation with a professional mediator to attempt to resolve the dispute. If mediation is unsuccessful, the parties mutually agree to submit the dispute exclusively to binding arbitration under the Commercial Rules of the American Arbitration Association, before a single arbitrator, within Rockwall County, Texas. The arbitrator may award attorney's fees and costs to the prevailing party. The entire proceeding, including its existence, shall be held confidential by the parties and shall not be disclosed except as necessary for confirmation or vacature of any award. In no event shall any consequential, punitive, or exemplary damages be awarded.

You waive any right to participate in any class action lawsuit or class-wide arbitration related to your use of the Site or these Terms.

11. Changes to These Terms
